1. Agreement to Terms

By accessing or using the ImmiWave platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and ImmiWave Inc. ("ImmiWave", "we", "us", or "our"), a Delaware corporation.

2. Description of Service

ImmiWave provides an AI-powered immigration case management platform that enables:

• Immigration practitioners to manage cases, clients, and documents
• Clients to upload documents and track application progress
• AI-assisted document verification and analysis
• Secure document storage and sharing

ImmiWave is a technology platform and does not provide legal advice, immigration consulting, or representation services.

3. Eligibility

To use ImmiWave, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete registration information
• Not be prohibited from using the Service under any applicable law

4. User Accounts

Account Registration

You must create an account to access the Service. You are responsible for:

• Maintaining the confidentiality of your credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Account Types

• Practitioners: Licensed immigration lawyers or RCICs who manage cases and clients
• Clients: Individuals whose immigration cases are being managed by a practitioner
• Providers: Third-party service providers assisting with immigration processes

Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could cause harm. You may delete your account at any time through your account settings.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload malicious files, viruses, or harmful code
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with unauthorized parties
• Use the Service to process data you do not have the right to process
• Misrepresent your identity, qualifications, or affiliations
• Scrape, crawl, or collect data from the Service without permission

6. Content and Documents

Your Content

You retain ownership of all documents and content you upload to the Service. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

Responsibility

You are solely responsible for:

• The accuracy and completeness of uploaded documents
• Ensuring you have the right to upload and share documents
• Verifying that documents meet immigration authority requirements
• Obtaining consent from individuals whose information appears in documents

AI Verification Disclaimer

Our AI document verification feature provides automated analysis to assist with document review. It is not a substitute for professional legal judgment. ImmiWave does not guarantee the accuracy of AI-generated analysis. Practitioners must review all AI outputs before making decisions based on them.

7. Intellectual Property

The ImmiWave platform, including its design, code, features, and underlying technology, is owned by ImmiWave Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

8. Fees and Payment

During the beta period, ImmiWave is provided free of charge. We reserve the right to introduce pricing upon general availability. We will provide reasonable notice before any pricing changes take effect.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• AI analysis results will be accurate or complete
• The Service will meet your specific requirements
• Any errors in the Service will be corrected

ImmiWave does not provide legal advice and is not a substitute for professional immigration counsel. Users are responsible for ensuring compliance with all applicable immigration laws and regulations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMMIWAVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or documents
• Loss of profits or business opportunities
• Immigration application denials or delays
• Unauthorized access to your account

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ImmiWave and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law
• Content you upload to the Service

12. Data Protection

Our collection and use of your personal information is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

For users in the European Union, these Terms do not affect your statutory rights under applicable EU consumer protection laws.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through a notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
